Insurance Requirement for Teams Playing on Sulphur Springs Athletic Field in the Parks1.1. USER at its own expense, shall obtain and keep in force during the term of this Agreement public liability insurance which will protect USER and CITY from all claims for damages to property and persons, and such insurance policy shall carry the City of Sulphur Springs, Texas as an additional insured, in the amount of at least one million dollars ($1,000,000.00) with such policy designed to cover cost of defense and liability for injuries suffered by participants and/or attendees. Said insurance shall protect CITY from and against all liabilities for claims arising out of or in connection with USER use and occupation of the premises. All insurance shall be issued by a company or companies of sound and adequate responsibility and authorized to do business in Texas. The type and limit of liability insurance is as follows: 1.1.1. Type of Insurance: Comprehensive General Public Liability 1.1.2.
Minimum Liability: $1,000,000.00 combined single limit for
bodily injury and property damage or on a per occurrence basis. USER selecting an Event User Agreement by written permission of the City Manager USER may be permitted to have all players and leaders sign a Liability and Injury Waiver instead of the required insurance. The written permission and the waiver will become a part of this Agreement in Exhibit E. 1.2. SAID insurance policies shall be subject to the examination and approval of the City Manager, as to adequacy. USER shall furnish CITY copies of such insurance policies prior to the execution of the Agreement, or prior to commencement of any activities by USER, at CITY facilities, whichever comes first. These approved policies shall become a part of this Agreement in Exhibit E. USER understands and agrees that it has sole responsibility to provide this information and failure to timely comply with the requirements under this Article shall be cause for cancellation of this Agreement. 1.3. USER agrees to procure insurance to cover accidental medical expenses for all players. The insurance benefit shall pay the excess of any expenses payable by other valid and collectible insurance to an insured person for an injury caused by a covered accident. Or Participants that are using an Event User Agreement and have written approval from the City Manager can use a liability and accident waiver by insuring that each participant complete and sign the statement below. A printable Microsoft Word copy of the waiver is found by CLICKING HERE. “I (PRINT NAME) understand that the activities at the City of Sulphur Springs, Texas, parks may have an element of hazard or inherent danger and that I take full responsibility for any injury or illness that may occur to myself, to (PRINT NAME) , (a minor), or to a family member(s) due to participation in these activities. I understand that it is my responsibility to obtain and cover myself or family member with liability and medical insurance for all claims at these activities. I agree to indemnify and hold harmless the City of Sulphur Springs, Texas, its employees, activity officials, activity supervisors, any or all of them, from any liability of any kind; losses; cost or expenses, including attorney’s fees; medical; ambulance charges or death that may occur while traveling or participating in any activity in the park. In the case of emergency, I give permission for emergency medical treatment or transport to a medical facility. This waiver will be considered valid until canceled or changed in writing by the undersigned participant, parent and/or guardian.”
